Welcome to GigOffers ("we," "us," "our").
These Terms of Use (“Terms”) govern your access to and use of the GigOffers website, mobile applications, products, and services (collectively, the “Platform”).
By accessing or using GigOffers, you (“User,” “Freelancer,” “Client,” or “you”) agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Overview of GigOffers
GigOffers is an online marketplace where Clients can find, hire, and pay Freelancers for freelance services (“Gigs,” “Projects,” or “Services”). GigOffers is not an employer, staffing agency, or party to the agreements between Clients and Freelancers.
2. Eligibility
To use the Platform, you must:
Be at least 18 years old
Have the legal capacity to enter a binding agreement
Not be suspended or removed from GigOffers
Use the Platform in compliance with applicable laws
Use of GigOffers is void where prohibited.
3. Account Registration
You must create an account to access certain features. You agree to:
Provide accurate and complete information
Maintain the confidentiality of your account credentials
Be fully responsible for all activity under your account
GigOffers reserves the right to refuse, suspend, or delete accounts at our discretion.
4. User Roles
4.1 Clients
Clients may:
Browse Freelancers
Post job listings or purchase Gigs
Hire Freelancers
Pay for completed work
4.2 Freelancers
Freelancers may:
Offer services
Apply to posted jobs
Deliver completed work
Receive payments through GigOffers
Freelancers are independent contractors, not employees of GigOffers.
5. Prohibited Activities
You agree NOT to:
Violate any law or regulation
Post false, misleading, or inaccurate information
Engage in fraud, spam, or harmful behavior
Attempt to circumvent the GigOffers payment system
Abuse, harass, or harm other Users
Upload malicious code or compromise security
Misrepresent your identity or qualifications
Sell or transfer your account
Violation may result in suspension or termination.
6. Job Posts, Gigs, and Deliverables
Clients may post Projects with clear descriptions and pricing. Freelancers must:
Deliver original, high-quality work
Meet deadlines
Communicate professionally
Clients must:
Provide clear instructions
Respond within reasonable timeframes
Not request free work or exploit Freelancers
GigOffers may remove posts that violate platform rules.
7. Payments, Fees & Billing
7.1 Payment Processing
All payments must be made through GigOffers.
We use third-party payment processors. By using GigOffers, you agree to their terms as well.
7.2 Freelancer Earnings
Freelancers earn the amount displayed after GigOffers’ service fee is deducted. Earnings can be withdrawn according to our withdrawal schedule.
7.3 Client Payments
Clients are charged upon:
Ordering a Gig, or
Funding a Project milestone
7.4 GigOffers Fees
Fees may include:
Service fees for Clients
Platform fees for Freelancers
Withdrawal or transaction fees
Fees are subject to change.
8. Refunds & Disputes
8.1 Refunds
GigOffers may issue refunds when:
Work is not delivered
Deliverables are incomplete
A dispute is resolved in Client’s favor
Refunds are not guaranteed and are evaluated individually.
8.2 Dispute Resolution
If a conflict occurs:
Client and Freelancer must attempt to resolve directly
If unresolved, either party may open a dispute
GigOffers’ resolution team will review submissions
GigOffers’ decision is final
GigOffers is not liable for losses resulting from disputes.
9. User Content
Users may upload text, images, files, portfolios, and other content (“User Content”).
You retain ownership, but grant GigOffers a worldwide, non-exclusive, royalty-free license to:
Display
Host
Modify (only for formatting)
Promote your content as part of the Platform
You warrant your content does NOT:
Violate copyright
Infringe trademarks
Contain harmful or illegal material
We may remove content at any time.
10. Confidentiality
Freelancers and Clients agree not to disclose or misuse confidential information exchanged through the Platform. GigOffers is not responsible for User-to-User confidentiality breaches.
11. Ratings & Reviews
Users may leave feedback after completing Projects. Reviews must be:
Honest
Relevant
Non-abusive
GigOffers may remove reviews that violate policies.
12. Intellectual Property
12.1 Freelancer Work Product
Unless otherwise stated:
Freelancer retains ownership until final payment
Upon full payment, ownership transfers to Client
12.2 GigOffers IP
All platform content (branding, UI, code, etc.) belongs to GigOffers.
Users may not copy, scrape, reverse-engineer, or exploit any part of the Platform.
13. Third-Party Services
GigOffers may integrate with third-party providers (payment processors, analytics, etc.).
We are not responsible for third-party actions, privacy practices, or service availability.
14. Limitation of Liability
To the maximum extent permitted by law:
GigOffers is not liable for indirect, incidental, or consequential damages
We are not responsible for user misconduct, disputes, payments outside the platform, or unauthorized access
Total liability for any claim will not exceed the amount paid by you to GigOffers in the last 12 months
Use the Platform at your own risk.
15. No Guarantee
GigOffers does not guarantee:
Freelancer quality
Client payment habits
Project outcomes
Platform uptime or error-free service
16. Termination
GigOffers may suspend or delete accounts if:
Terms are violated
Illegal activity is suspected
Payment or fraud risks exist
Users may request account deletion at any time.
17. Changes to Terms
GigOffers may modify these Terms at any time. Updated Terms become effective upon posting. Continued use of the Platform constitutes acceptance of the changes.
18. Governing Law
These Terms are governed by the laws of [Insert Country/State], without regard to conflict-of-law principles. Any disputes must be resolved in courts located in [Insert Jurisdiction].
